General conditions of use of the site

Article 1 - Purpose and acceptance

The purpose of the present General Terms of Use (hereinafter the "GTU") is to set the rules for the use of the website https://www.highflyers.agency/ (hereinafter the "Site") published by HIGH FLYERS AGENCY, a simplified joint stock company with a capital of €23,391, registered under the number 814 113 205 RCS Paris, whose registered office is located at 50 rue de Rennes - 75006 Paris - France (hereinafter the "Publisher" of the Site).

Any use of the Site implies the acceptance of the present TOS, including the Data Protection Policy and the Cookies Policy. If the User wishes to use the services offered on the Site, this use will be completed by the General Terms of Use of the Services.

The relationship between the Publisher and its customers, legal entities, employers likely to use the services available on the Site (hereinafter the "Customers") are subject to contractual conditions that are specific to them.

By continuing to browse the Site, the User acknowledges having read and accepted, without restriction or reservation, the present Terms and Conditions. If the User does not accept the GCU in their entirety, it is up to him to leave the Site immediately.

The Editor reserves the right to modify the present GTU at any time and without notice. It is up to the User to regularly consult this page in order to take note of possible updates or modifications of the GTU, which take effect as soon as they are put online. The Editor also reserves the right to modify, interrupt or suspend all or part of the functionalities or the content of the Site, at any time and without notice. The Editor cannot be held responsible for such modifications.

Services : refers to all the recruitment and matchmaking services that the Editor offers to Users on the Site.

Site : refers to the fixed Internet site published by the Editor, accessible at the address https://www.highflyers.agency/ which allows access to the Services.

User : refers to any Internet user, natural person of legal age, accessing the Site.

Article 2 - Access to the Site

The access to the Site and to the Services which are proposed there is reserved to the major Users. To this end, the Publisher reserves the right (i) to proceed to any control concerning the age of the person concerned and (ii) if necessary, to immediately delete the form filled in by the User to access the Services if this condition was not met.

The Editor makes every effort to ensure that the Site is accessible at all times, without however being able to provide any guarantee to the User on this point. The Site may indeed be temporarily offline for maintenance, update, technical incident or for any other reason independent or not of the Publisher's will. The Editor declines any responsibility for any damage, direct or indirect, resulting from the interruption, the suspension or the impossibility to access the Site and/or the Services accessible on the latter.

The Editor reserves the right, at its sole discretion, to limit, suspend or terminate access to all or part of the Site, to the Services offered on the Site, without prior notice and without this being likely to give rise to any compensation to a User.

Article 3 - Use of the Site

The Publisher provides Users with Services on its Website.

The access to the Services supposes that the User fills a form and that he accepts the General Conditions of Use of the Services.

Mandatory information is indicated by an asterisk. If the User fails to provide this information, he/she will not be able to access the Services. The User is informed that the personal data that he/she is led to transmit on this occasion are subject to processing under the conditions provided for in Article 10 of these Terms of Use. An e-mail confirming registration for the Services is then sent to the e-mail address indicated by the User.

The User may decide to delete his registration to the Services, according to the terms and conditions provided. In this case, the User must send his request by e-mail to the following address: contact@highflyers.agency. The User is informed that the deletion of his registration does not entail the cancellation of the past connections. If the User wishes to have all of his or her data deleted, he or she is invited to exercise his or her right to erasure as provided for in Article 10 hereof by specifying his or her request.

 

Article 4 - Commitments and guarantees of the user

5.1 Commitments relating to the use of the Site

The User acknowledges that the use of the Site and the Services are optional and that he/she is solely responsible for the use he/she makes of them. The User agrees to respect the present Terms of Use, the General Terms of Use of the Services, the legislation in force and not to infringe the rights of third parties or public order.

The User undertakes in particular that any information or words that he communicates within the framework of the use of the Site and the Services:

Is true, accurate, up to date and complete and in no way misleads the Editor or third parties. The User commits to update the information he has initially communicated if it has changed;

Be lawful and in no case of a defamatory nature or prejudicial to public order as well as to the interests and/or image of the Editor or any third party. The User agrees not to create a false identity and not to impersonate another person or entity;

Does not contain spam;

Does not contain any information harmful to the computer system of the Editor or any third party (such as viruses, worms, Trojan horses, etc.);

Is not of a nature to harm the rights and commercial, financial or moral interests of the Editor or any other User.

The User agrees in particular to provide true and accurate information about his professional background, qualifications and work experience. The Editor is likely to verify all this information.

The User also undertakes to make fair, rational and non-abusive use of the Site, which excludes any act of negligence or malice. The User also undertakes in a general way not to carry out any operation likely to alter or interrupt the functionalities of the Site.

The User acknowledges that he/she is equipped with the necessary computer tools and has an Internet connection to use the Site. Telecommunication costs to access the Site are the exclusive responsibility of the User. In this regard, the User acknowledges that he/she is solely responsible for preserving the security of his/her computer equipment when using the Site.

5.2 - Consequences of breaches

In case of breach by the User of one or more of the rules mentioned above, the Editor may, immediately and without notice or compensation, temporarily suspend and / or permanently terminate access to all or part of the Site and Services. The User will be notified of such a decision by e-mail.

The User guarantees the Editor against any complaint, claim, action and/or vindication that he could undergo because of any breach committed relating to any of his commitments under the terms of these GCU.

In such case, the User agrees to indemnify the Publisher, to the extent of its responsibility for the commission of such breach, against all costs (including all costs, losses, expenses, legal fees, attorney's fees, and amounts paid as damages) that the Publisher may incur.

6.5 - Limitation of responsibility

The Editor cannot guarantee the total computer security of the Site. The Editor declines any responsibility in case of direct or indirect damage suffered by the User resulting from

all interruptions, breakdowns, malfunctioning of the Site, whatever the origin and whatever the support used, likely to impact among others the access of the Users to the Site;

any temporary or permanent unavailability of the Site and/or Services for any reason whatsoever, including due to technical failures (disconnection, interference from third parties, hacking, viruses, etc.), whatever the origin and/or in case of temporary or permanent unavailability of the Internet network;

any illicit use of the Site and/or Services by another User or use of the Site and/or Services in conditions that do not comply with the terms of these TOS.

The Editor will inform the User in advance of the unavailability of the Site and/or Services if the event causing the unavailability is foreseeable.

The User is invited to report any malfunction or any illicit or inappropriate content he notices on the Site as soon as possible to the e-mail address indicated in the "Contact" clause.

Moreover, the responsibility of the Editor could not be committed in the event of dysfunction of some nature that it is relating to the hardware of the User and/or his Internet connection, during the access to the Site.

Finally, the responsibility of the Editor could be engaged only under the conditions of common law, because of the direct and foreseeable damage undergone by the User resulting from any failure of the Editor to the present GTU. The Editor will not be held responsible for any indirect damage, such as any moral, commercial or financial prejudice, loss of profit, loss of opportunity, action directed against the User by a third party and the resulting consequences.

Article 7 - Hypertext links

The Site may contain links to other sites that are neither operated nor controlled by the Publisher. The Editor cannot be considered as responsible for these sites and declines any responsibility for their content, legality, accuracy or function, products or services available on or from these sites.

The setting up of any hypertext link by a third party to all or part of the Site is strictly forbidden, except with the prior written authorization of the Publisher.

The responsibility of the Editor could not also be committed because of the access by the User to the contents of the resources consulted via the hypertext links of Internet sites published and managed by thirds on the Site. The responsibility of the Editor could not also be committed because of possible problems of safety and/or integrity and of any other damage which could result from its use of these third sites for which it remains only responsible.

Article 8 - Force majeure

In the event of a case of force majeure as defined by the law and the jurisprudence of the French courts, the obligations of the User and the Publisher will be suspended and their responsibility will not be engaged in such cases.

Article 9 - Intellectual property

The structure and contents made available on the Site, in particular, images, sounds, videos, photographs, articles, logos, trademarks, graphic, textual and visual elements, downloadable elements, documents, etc. are the exclusive property of the Publisher, subject to rights belonging to third parties. They are protected by all intellectual property rights and any other right recognized by the legislation in force. It is specified that the brand " High Flyers Agency" is a registered trademark at the Institut National de la Propriété Industrielle (I.N.P.I).

The User is not authorized to copy, use or reproduce the trademarks, logos, corporate names, acronyms, trade names, signs and/or domain names of the Publisher without the express prior authorization of their owner.

The User is not authorized to copy, use, reproduce, distribute any other content of the Site on any medium whatsoever, whether in return for payment or free of charge, nor to transfer in any way whatsoever any right relating to the Site; such use being likely to constitute an infringement and/or other violation of the rights and regulations in force.

Article 10 - Personal data

In accordance with the Law n°78-17 of January 6, 1978 relating to data processing, files and freedoms as amended and the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council) of April 27, 2016, the Publisher acts as a data controller and implements a processing of personal data relating to Users.

The processing of such personal data is the subject of a separate Data Protection Policy accessible HERE.

Users are informed that they have the right to access, rectify, delete, oppose, limit and port their data under the legal conditions, and the right to formulate specific and general directives concerning the conservation, deletion and communication of their data post mortem. The Editor reserves the right to request proof of identity from any applicant. Any person concerned also has the right to lodge an action with the CNIL.

Article 11 - Entirety

The present GTU, the Data Protection Policy and the Cookie Policy constitute the entire agreement between the User and the Publisher regarding the subject matter hereof. They supersede all prior promises, representations, agreements and understandings of any kind whatsoever between the parties.

The Publisher's failure to exercise or enforce any right or provision of the TOU shall not constitute a waiver of such right or provision. If any provision of the TOU is found by a court of competent jurisdiction to be unenforceable or invalid, the parties agree that the court should endeavor to give effect to the parties' intentions as reflected in that provision, and the other provisions of the TOU remain in full force and effect.

The Publisher reserves the right to assign or transfer to any third party, in any manner and at any time, all or part of its rights and obligations under the TOU.

 

Article 12 - Applicable law and jurisdiction

The present GTU as well as any question relating to the Site, are governed by French law, subject to the application of the imperative provisions of the law of the State in which the User has his habitual residence if it is located on the territory of the European Union.

Any dispute in connection with the use of the Site or arising from these GTUs shall be submitted, failing amicable resolution between the parties, to the jurisdiction of the competent courts.
